These Tree Surgeons Uxbridge Terms and Conditions set out the basis on which tree surgery services are provided to residential, commercial, and public-sector clients. By making a booking, accepting a quotation, or allowing work to commence, the customer agrees to be bound by these terms. They are designed to create a clear understanding of the service scope, payment arrangements, cancellation rules, responsibilities for access and permissions, waste handling, and the limits of liability that apply to arboricultural work.
Throughout this document, references to “we”, “us”, and “our” mean the tree surgery contractor, and references to “you” and “your” mean the customer or the person acting on behalf of the customer. These terms apply to all tree surgery services, including pruning, crown reduction, crown lifting, hedge cutting, tree felling, stump grinding, deadwood removal, site clearance, and associated arboricultural operations, unless a separate written agreement states otherwise.
Any quotation, estimate, or proposal is based on the information available at the time it is issued. Tree surgery work is often dependent on the condition, size, location, and accessibility of the trees involved. For that reason, estimates may change if the situation on site differs materially from the description provided during the enquiry. The customer is responsible for supplying accurate information, including details of boundary issues, tree protection orders, shared access, underground services, or any hazards that may affect the works.
Booking Process
Bookings for Uxbridge tree surgeons services are usually confirmed in writing after the customer accepts the quotation or estimate. Acceptance may be given by email, signed approval, text message, or another recorded method agreed between the parties. Once accepted, a provisional date or timeframe may be allocated. If access is delayed or prevented, we may charge reasonable additional costs, including waiting time, return visit fees, or wasted attendance charges. For larger jobs, the customer should also ensure that suitable parking or loading space is available for vehicles, chippers, stump grinders, or other equipment.
We will use reasonable skill and care in providing tree surgery in Uxbridge and in carrying out the agreed works in a professional manner. However, natural variation in trees means that outcomes such as regrowth patterns, leaf density, or long-term structural response cannot be guaranteed. Where arboricultural judgment is required, our team will act in accordance with recognised industry practice and current health and safety standards.
Payments and Charges
Unless otherwise agreed in writing, payment is due upon completion of the work on the same day that the service is delivered. For larger projects, we may require a deposit, staged payments, or advance payment for materials, machinery, hire charges, traffic management, or waste disposal. Any deposit will be confirmed at the time of booking and may be used to reserve labour, machinery, and dates.
Invoices must be paid in full within the stated payment period, usually by bank transfer or another approved method. If payment is not received on time, we reserve the right to charge statutory interest and reasonable recovery costs in line with applicable UK law. Late payment may also result in the suspension of further work, withholding of certificates or documentation not yet required to be issued, or cancellation of future appointments.
All prices are quoted in good faith but may be adjusted if the scope of work changes. Any material change will be discussed with the customer before additional charges are incurred, where reasonably practicable.
Unless expressly stated otherwise, prices are exclusive of VAT, permits, road closures, parking charges, and third-party fees. If VAT applies, it will be added at the prevailing rate. Where a quotation states that waste is included, it refers only to the quantity and type of arisings reasonably expected from the agreed works. Significant extra waste may incur an additional charge.
Cancellations and Rescheduling
The customer may cancel or request to reschedule a booking by giving reasonable notice. Where cancellation is made with sufficient notice, no charge may be applied, though any non-refundable costs already incurred may still be payable. If cancellation occurs after we have allocated labour, hired equipment, arranged traffic control, or mobilised a team to site, we may charge for losses reasonably suffered as a result of the cancellation.
If the customer cancels with little or no notice, or if we are unable to complete the work because access, permissions, or safety conditions are not ready, we reserve the right to charge a cancellation fee or a minimum attendance fee. This is particularly relevant where a full team, specialist climbing equipment, stump grinding machinery, or chipper hire has been scheduled for the job.
We may also reschedule work where weather conditions, high winds, storms, heavy rain, ice, or other conditions make tree surgery unsafe or impractical. If we need to postpone for safety reasons, we will offer an alternative date as soon as reasonably possible. We are not liable for any indirect loss arising from a necessary rescheduling, provided the decision was made reasonably and in good faith.
Liability and Site Risks
Tree surgery is inherently hazardous. While we take all reasonable precautions, certain risks cannot be eliminated completely. The customer accepts that minor impacts to lawns, flowerbeds, fencing, driveways, or surface materials may occur where heavy machinery or timber handling is necessary and the ground is soft or access is limited. We will take reasonable care to minimise disturbance, but we are not responsible for pre-existing defects, unstable structures, hidden drains, buried cables, or underground obstructions not reasonably discoverable before work starts.
Our liability for direct loss or damage caused by our negligence is limited to the amount recoverable under our insurance, subject always to any legal limits that cannot be excluded. We do not exclude liability for death or personal injury caused by our negligence, fraud, or any other matter which cannot lawfully be excluded under UK law. We will not be liable for indirect, consequential, or economic losses such as loss of profit, loss of use, or business interruption, unless required by law.
Where trees are close to buildings, conservatories, glass structures, sheds, utility lines, or neighbouring property, the customer acknowledges that access and working space may be constrained. In these situations, we may require the customer to move delicate items, protect vulnerable surfaces, or obtain third-party consent. If you choose not to take recommended protective measures, you accept the associated risk to the extent permitted by law.
Any advice given by our tree surgeons, whether written or verbal, is based on the information made available at the time. Advice about pruning, removal, disease management, or future maintenance is provided in good faith, but it does not amount to a guarantee of tree health, growth performance, or future stability. Natural conditions, weather events, pests, disease, and soil movement can all affect outcomes after the service has been completed.
The customer is responsible for ensuring that any vulnerable persons, vehicles, personal property, or animals are kept clear of the work area. We may suspend work if, in our view, the area is not safe to continue. If work must be paused because the customer has failed to provide a safe environment, additional charges may apply for idle time, return visits, or re-mobilisation.
Waste Regulations and Disposal
All green waste, timber, brash, woodchip, and stump arisings remain subject to applicable waste handling rules. Unless agreed otherwise, waste created during the job will be removed, processed, recycled, or disposed of by us in accordance with UK waste regulations and the duty of care requirements applicable to the business. We aim to reuse or recycle as much material as reasonably practicable.
If you request to keep logs, woodchip, or other arisings, that arrangement must be agreed in advance and may be subject to space availability, safe handling limits, and separate sorting. Once waste is removed from site, it becomes our responsibility and will be managed through lawful routes. We do not permit unlawful dumping, burning, or transfer of waste to unlicensed parties. Any customer who requests disposal contrary to regulations will be refused.
The customer must disclose any known contamination or non-green materials in the waste area, including wires, fixtures, treated timber, rubble, asbestos, or hazardous substances. If such materials are discovered unexpectedly, we may halt removal and charge for segregation, specialist disposal, or additional safety controls. We are not obliged to handle any material that would expose us to unlawful risk or regulatory breach.
Customer Responsibilities
The customer must provide truthful information when requesting a quotation and must notify us promptly of any change that could affect the work. This includes changes to access, ownership, tree condition, or any objections from neighbours, tenants, management companies, or local authorities. Failure to disclose relevant facts may lead to revised pricing, delays, or cancellation.
It is the customer’s responsibility to confirm that they have the authority to instruct the work. If you are not the property owner, you must ensure that the owner or managing party has given permission. For shared boundaries or jointly owned trees, you must obtain all necessary consents before the work begins. We are not responsible for disputes between neighbours or other interested parties.
Where utilities are located near the work area, the customer should tell us in advance if they are aware of any underground or overhead services. Although our team will take care to work safely, we cannot guarantee detection of every concealed service. The customer accepts that any additional precautions required because of unknown site conditions may increase cost and duration.
Complaints, Variations, and Termination
If the customer believes the service does not match the agreed scope, they must notify us as soon as reasonably possible so the matter can be reviewed. We may ask for photographs, details of the concern, and an opportunity to inspect the work. In many cases, a reasonable discussion can resolve issues without delay. No claim will be accepted for matters that arise from the customer’s own instructions, a natural tree response, or conditions outside our control.
Any variation to the original booking must be agreed in writing wherever practicable. A variation may affect price, timing, labour, machinery, and waste removal. If the customer asks for extra work on the day, we may provide a new price before proceeding. Verbal changes are only binding if later confirmed by us, and no one on site may assume additional work is included unless it has been clearly agreed.
We reserve the right to terminate or suspend services if the customer behaves abusively, refuses to make payment when due, withholds required access, or creates an unsafe working environment. In such circumstances, the customer remains liable for work already completed, materials ordered, and reasonable costs incurred. Termination does not affect rights or obligations that have already accrued.
These terms are governed by the laws of England and Wales. Any dispute arising from or connected with the services, quotation, booking, payment, or these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. This applies whether the issue concerns tree surgeons in Uxbridge, arboricultural work more broadly, or any related service provided under these terms.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. No failure or delay by either party in exercising any right under these terms shall operate as a waiver of that right. These terms represent the full agreement between the parties for the services described and replace any prior oral discussions or informal understandings, unless a signed written variation states otherwise.
